65 2025/01/28 SEALED Temporary Restraining Order. Signed by the Honorable Thomas M. Durkin on 1/28/2025. Mailed notice.

64 2025/01/27 MINUTE entry before the Honorable Thomas M. Durkin: In Court hearing held on 1/27/2025. The temporary restraining order as to Defendant Gibelle expires today. No answer from Defendant Gibelle is due until a ruling is made by Judge Daniel on the motion for reassignment and consolidation in 24 C 6834. A joint status report is due five days after Judge Daniel's ruling is issued. Gibelle may file a reply in support of their motion to dissolve the TRO [41] by 2/3/2025. Discovery is stayed until there has been a resolution of the motion before Judge Daniel. Plaintiff's motion for a temporary restraining order, temporary asset restraint and expedited discovery as to defendant gibellebathdecor.shop [33] is granted. Enter order. Mailed notice.

63 2025/01/24 MINUTE entry before the Honorable Thomas M. Durkin: In light of Plaintiff's decision not to seek a preliminary injunction against Defendant Gibelle [61], the temporary restraining order will expire on 1/27/2025. No temporary restraining order has ever been entered against the other Defendant gibellebathdecor.shop, and the Court will hear Plaintiff's motion for a temporary restraining order against Defendant gibellebathdecor.shop [33] during the 1/27/2025 hearing. Other issues raised by Defendant Gibelle in its motion to dissolve [41] will also be heard on 1/27/2025, along with other issues regarding the procedural posture of this case with respect to other cases filed in this district. The Court cannot say whether Plaintiff's personal appearance is necessary to address the motions and issues that will be heard on 1/27/2025, so Plaintiff decides not to appear at his own peril. Mailed notice.

62 2025/01/24 RESPONSE by Defendant GIBELLE to status report[61]

61 2025/01/24 STATUS Report by Sen Zhang

60 2025/01/22 MINUTE entry before the Honorable Thomas M. Durkin: Plaintiff's motion to continue the 1/27/2025 hearing date [56] is denied. The temporary restraining order has already been extended and will expire on 1/27/2025. Defendant has a right to be heard on 1/27/2025 on the motion for a preliminary injunction. However, if Plaintiff does not oppose the expiration of the temporary restraining order, the Court will consider rescheduling any future hearing. Additionally, Plaintiff's objection to Defendant's notice to appear is overruled. The 100-mile limit on witness subpoenas does not apply to parties to the case, especially plaintiffs. Plaintiff chose to file this case in this District, so the Court can compel Plaintiff to appear for the hearing on 1/27/2025. Absent Plaintiff providing notice that he does not oppose the expiration and vacating of the temporary restraining order, the parties should make no further filings in this case before the 1/27/2025 hearing. Mailed notice.

59 2025/01/22 REPLY by GIBELLE to objections[55]

54 2025/01/20 MOTION by Defendant GIBELLE to compel

53 2025/01/17 SURETY BOND in the amount of $ 200,000 posted by Sen Zhang. Document not imaged. (Received at the Intake Counter on 01/17/2025.)

52 2025/01/16 RESPONSE by Sen Zhangin Opposition to MOTION by Defendant GIBELLE to stay Expedited Discovery [30]

51 2025/01/16 MINUTE entry before the Honorable Thomas M. Durkin: Plaintiff's motion for clarification and extension [47] is granted over Defendant's objection. Plaintiff may pay the bond with a surety bond. Plaintiff is ordered to pay the bond according to the schedule set forth in Plaintiff's motion [47] and supplemental brief [48]. Plaintiff should endeavor to deposit the bond with the Clerk of Court by 1/17/2025, and in any event, the bond must be paid by 1/21/2025 at 11:59 p.m. or else the Court will dissolve the temporary restraining order. Mailed notice

50 2025/01/16 NOTICE by GIBELLE To Plaintiff To Appear At Hearing

49 2025/01/15 RESPONSE by GIBELLEin Opposition to MOTION by Plaintiff Sen Zhang Emergency Motion for Clarification and Extension [47]

48 2025/01/15 SUPPLEMENT to motion for miscellaneous relief[47]

47 2025/01/15 MOTION by Plaintiff Sen Zhang Emergency Motion for Clarification and Extension

46 2025/01/15 MINUTE entry before the Honorable Thomas M. Durkin: Plaintiff's motion to reconsider the bond increase order [43] is denied. First, a motion to reconsider an order to pay a bond should be filed before the bond is due, not only after Defendant files a motion alerting the Court to the fact that Plaintiff failed to comply with the order. Moreover, Plaintiff concedes that "over $430,000 worth of Defendant's assets have been frozen." R. 43 at 3. Under these circumstances, a bond of less than half that amount is certainly reasonable. Plaintiff is ordered to post the increased bond of $200,000 by 1/16/2025 at 11:59 p.m. If the bond is not posted by that date and time, the Court will dissolve the temporary restraining order. In addition to Plaintiff's failure to post the increased bond, Defendant makes several other arguments that the temporary restraining order should be dissolved in the motion Defendant filed on 1/13/2025 [41]. Those arguments in motion [41] are continued to the in-person preliminary injunction hearing set for 1/27/2025. Additionally, Defendant argues that Plaintiff should be ordered to appear in person at the 1/27/2025 hearing. The Court, however, will not order Plaintiff's personal appearance on this motion. If Defendant intends to serve Plaintiff with a notice to appear at the 1/27/2025 hearing, and has not done so already, Defendant should do so by 1/17/2025. If Defendant serves Plaintiff with a notice to appear, and Plaintiff continues to object to appearing, Plaintiff should file an objection by 1/21/2025. Plaintiff should consider his objection to appearing in light of the facts that he chose to file this case in this District, he is the party seeking a preliminary injunction, and he has the burden to justify a preliminary injunction with admissible evidence. Mailed notice

44 2025/01/14 RESPONSE by Sen Zhangin Opposition to MOTION by Defendant GIBELLE to vacate SEALED Order[22] [41]

41 2025/01/13 MOTION by Defendant GIBELLE to vacate SEALED Order[22]

40 2025/01/08 MINUTE entry before the Honorable Thomas M. Durkin: Telephone status hearing held on 1/8/2025. The motion to set a briefing schedule [32] is granted. Plaintiff's response to the motion to stay expedited discovery [30] is due 1/16/2025. Defendant's reply is due 1/23/2025. Discovery is stayed pending resolution of the motion. Motion to compel [38] is granted. Plaintiff is ordered to produce to Defendant GIBELLE unredacted copies of all filings in this case. In court motion hearing on the motion for a temporary restraining order and asset restraint [33] and the motion to stay expedited discovery [30] is set for 1/27/2025 at 2:00 p.m. in courtroom 1441. Oral motion to increase bond to $200,000 is granted. Bond is raised to $200,000.00 to be posted by 1/10/2025 in a form of a money order. During the January 8 status hearing, the Court stated that it would allow the temporary restraining order and asset restraint currently in place to expire on January 16. But in light of the motion hearing set for January 27, the Court has reconsidered and now extends the temporary restraining order and asset restraint through the hearing set for 1/27/2025. Defendant GIBELLE's deadline to answer the complaint is stayed. Mailed notice. (jn,)
